Beta Evaluation Agreement
This agreement is between the applicant (“you”) and JML Tech Studios LLC (“JML Tech Studios”) and becomes effective when you electronically accept it with your application.
1. Eligibility and program status
You confirm that you are at least 18 years old, live in the United States, can enter this agreement, and submitted accurate information. Applying does not guarantee selection, an evaluation unit, payment, employment, a preorder, or any future product. Participation is voluntary and may be ended by either party at any time.
2. Evaluation commitment
If selected, you agree to follow the test plan, use reasonable care, report defects and safety concerns promptly, complete agreed check-ins, and provide candid feedback. JML Tech Studios does not require positive feedback, a favorable review, or a public endorsement. Failure to participate may end your access to the beta.
3. Evaluation product and ownership
Any Oneira evaluation unit or pre-release accessory provided for evaluation remains the property of JML Tech Studios unless a later signed writing says otherwise. You may not sell, transfer, pledge, open, alter, copy, decompile, reverse engineer, or permit another person to use it. On request or at the end of testing, you must stop using it and return it using the provided instructions. Reasonable wear from authorized testing is expected; intentional damage, misuse, loss, or an unreturned unit may make you responsible to the extent permitted by law.
4. Confidential information
Pre-release hardware, nonpublic features, test instructions, unreleased software, credentials, technical findings, launch plans, and private program communications are confidential. You may use them only for the beta and may share them only with authorized JML personnel. This duty does not cover information you can document was already public through no breach, lawfully known without restriction, independently developed, or lawfully received from another source. Confidentiality lasts two years after the program; trade secrets remain protected while they qualify as trade secrets under applicable law.
5. Safety and responsible use
Oneira beta units are real product hardware running pre-release software and may fail, behave unexpectedly, become warm, lose data, or differ from the retail release. Follow all safety and charging instructions. Stop using and disconnect the unit immediately if it is damaged, swollen, unusually hot, wet beyond instructions, or otherwise appears unsafe, and notify JML Tech Studios. Do not rely on it for medical, emergency, life-safety, navigation, or security-critical use.
6. Feedback and public statements
You keep ownership of your original feedback. You grant JML Tech Studios a perpetual, worldwide, royalty-free, nonexclusive license to use, reproduce, modify, analyze, and incorporate that feedback to develop, operate, market, and improve its products and services. You are not required to post publicly. If JML authorizes a public post and you received free or discounted access, you agree to clearly disclose that relationship and state your honest experience.
7. Data and permissions
JML Tech Studios may collect application answers, device and diagnostic data, test logs, support communications, and feedback needed to administer and improve the beta, as described in the Privacy Policy and test notices. Marketing email consent and permission to use your name, image, voice, or testimonial are separate and optional; declining either does not reduce your application score.
8. No warranty; limits required by law
To the fullest extent permitted by law, beta materials are provided as-is and as-available without promises that they will be uninterrupted, error-free, safe for every use, or commercially released. Nothing in this agreement excludes rights or liability that cannot legally be excluded. To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, exemplary, or consequential damages arising from the beta.
9. Ending participation and return
JML Tech Studios may pause or end the beta, revoke access, or request return of an evaluation unit for safety, security, nonparticipation, breach, or program needs. You may withdraw by contacting the program. Confidentiality, ownership, feedback license, disclosures, return duties, and other provisions intended to survive remain effective after participation ends.
10. Wisconsin law, entire agreement, and electronic signature
Wisconsin law governs this agreement without regard to conflict-of-law rules, except where another law must apply. This agreement and incorporated privacy or test notices are the entire beta evaluation agreement and may be changed only in a writing accepted by both parties. If a provision is unenforceable, the remaining provisions continue. By checking the acceptance box and typing your legal name, you intend to sign electronically and consent to receiving and retaining this agreement electronically.
